Terms & Conditions – Rental Services

Implied Acceptance:
In the absence of a physical or digital signature, the client’s acceptance of the invoice and/or payment of the first rental fees shall be deemed as full acceptance of these Terms & Conditions, enforceable under the Indian Contract Act 1872.


  1. Rents are NOT transferable. All rented equipment must be returned in person to Avizar Info Services Pvt. Ltd. (“NikkiTech”), House No. 42, Gali No. 4, Block B, Vinay Nagar Agwanpur Extn., Sector 91, Faridabad – 121013, Haryana.

  2. Care of Equipment: The renter must exercise due care to prevent loss or damage for the entire rental period.

  3. Responsibility for Loss/Damage: The renter accepts full responsibility for any loss or damage resulting from negligence or improper use (including use contrary to manufacturer or NikkiTech instructions, purpose, or leaving equipment unattended/unsecured).

  4. Repair/Replacement Costs: The renter shall bear the full cost of repair or replacement for any equipment lost or damaged due to negligence or improper use.

  5. Payment Terms: The agreed rental fee for each laptop/desktop/accessory plus a refundable security deposit (minimum 30‑day hire) is payable in advance by NEFT/RTGS. Deposits are refunded to the originating account after satisfactory return‑inspection.

  6. Lock‑in Period & Termination by Notice: This agreement has a default lock‑in period of 11 months from the start date. However, this duration may be modified as mutually agreed upon and mentioned in the invoice or agreement summary. During the agreed lock‑in, either party may terminate by giving 30 days’ prior written notice citing breach, non‑performance, or other valid cause. After the lock‑in, either party may terminate on 7 days’ written notice.

  7. Return of Equipment: All rented items must be physically returned for inspection before any deposit is released.

  8. Renewal: To extend a rental, the renter must notify NikkiTech at least 2 days before the expected return date.

  9. Late Returns: Late returns incur a ₹200 per‑day penalty and deposit withholding.

  10. Extended Charges: Equipment kept more than 7 days beyond the due date automatically attracts charges for the next full month.

  11. Return Deadline: The last rental issue is at 6 PM daily; returns must be made 1 hour before closing. Current timings are on www.nikkitech.in.

  12. Cancellation by NikkiTech: NikkiTech may cancel and demand return with 7 days’ written notice. Invoices overdue beyond agreed terms allow immediate termination and legal recovery, irrespective of lock‑in or notice.

  13. Early Cancellation & Deposit Forfeiture: Cancellation by either party within 3 months of commencement forfeits the entire security deposit.

  14. Theft Reporting: The renter must notify NikkiTech immediately of theft and provide an FIR number.

  15. Theft Liability: The renter bears the full cost of stolen laptop/desktop/accessories as quoted by NikkiTech.

  16. Failure to Return: Non‑return may be reported as theft and trigger recovery procedures.

  17. Data Management: Save work to external or cloud storage. All local data will be wiped on return.

  18. Power Supply: Recharge equipment only with the supplied adapter and mains power.

  19. Technical Issues: Report faults to NikkiTech; do not attempt repairs, which void warranty and incur liability.

  20. Prohibited Alterations: Do not modify hardware or install software without prior written approval.

  21. Ownership: All equipment remains NikkiTech property. Unreturned/damaged units will be invoiced at full replacement value.

  22. Software & Licensing: All installed software must be properly licensed and comply with Indian copyright law.

  23. Admin Password: An admin password may be provided on request for approved installations.

  24. Remote Assistance: NikkiTech offers remote support via AnyDesk for software/admin issues.

  25. Technical Support Hours: Monday–Saturday, 10 AM – 8 PM IST. Rental charges continue during unavoidable support delays.

  26. Late Payment: Invoices are due within 7 days of issue. Late payments incur ₹100 per day per unit until cleared. Accounts overdue 15+ days permit immediate agreement termination and legal action, notwithstanding lock‑in or notice.

  27. Hardware Failure & Resolution: Report non‑fault‑induced hardware failures immediately. NikkiTech will repair/replace within 3 working days; otherwise, pro‑rated rent will be credited for downtime. User‑caused damage is excluded.

  28. Indemnity: The renter indemnifies NikkiTech and its representatives against all claims, losses, or expenses arising from rental use, including recovery or enforcement costs.

  29. Acknowledgement & Agreement: Continuing with payment, equipment acceptance, or service use constitutes acknowledgement of and agreement to these Terms & Conditions.

Jurisdiction:
All disputes are subject exclusively to the courts of Faridabad, Haryana, India.
